ARTICLE 1 – DEFINITIONS The following definitions are provided to facilitate the understanding of these Terms and Conditions of Service:

  • Withdrawal period: legal time frame in which the consumer can cancel a contract without obligation to provide reasons.

  • Consumer: any natural person who enters into a contract with casaditempo.it for purposes unrelated to their commercial or professional activity.

  • Continuing contract: agreement that provides for the regular supply of goods or services for a set period.

  • Durable medium: means that allows the consumer to store information accessible and reproducible over time (e.g. PDF, email, USB stick).

  • Right of withdrawal: consumer's right to withdraw from the contract within the period provided by law.

  • Professional: natural or legal person acting in the context of their entrepreneurial or professional activity.

  • Distance contract: contract concluded exclusively through remote communication means (e.g. internet, email, telephone).

  • Remote communication tools: technologies that allow the conclusion of the contract without physical presence (internet, telephone, email, fax).

  • General Terms and Conditions (TCG): legal conditions applied by casaditempo.it in contracts with consumers, especially in online sales.

ARTICLE 3 – SCOPE OF APPLICATION These TCG govern all distance contracts concluded between casaditempo.it and the customer, regardless of the device or platform used for the purchase.

Acceptance of the conditions occurs by selecting the appropriate box before confirming the order. Any different conditions from the customer are not valid unless agreed in writing.

In case of electronic purchase, the customer will receive a copy of the TCG in durable format, for example as an attachment to the order confirmation or via link.

Any specific conditions for individual products will be indicated in the relevant sections. In case of conflict, the conditions most favorable to the consumer prevail.

ARTICLE 4 – OFFERS AND PRODUCT DESCRIPTIONS Product descriptions on casaditempo.it do not constitute binding offers, but mere invitations to purchase.

All offers are valid while stocks last or until the indicated expiration. Limitations such as quantity or validity of promotional codes will be clearly specified.

casaditempo.it reserves the right to modify assortment, prices, product information, and delivery conditions. Any printing or description errors do not entitle contractual claims.

Product images are indicative and may differ slightly from what is delivered.

Each offer includes information on:

  • any additional costs (customs, taxes, shipping);

  • applicable right of withdrawal or not;

  • technical steps to complete the order;

  • available means of communication;

  • languages available for the contract;

  • duration of fixed-term contracts.

ARTICLE 5 – CONCLUSION OF THE CONTRACT The contract is concluded when the customer clicks "Buy Now" and accepts the TCG. This represents a binding offer.

Order receipt is confirmed via email but does not constitute acceptance. The contract is finalized with the shipping confirmation or delivery of the goods.

casaditempo.it reserves the right to refuse orders in case of abuse, suspected fraud, or product unavailability.

ARTICLE 6 – RIGHT OF WITHDRAWAL The consumer may withdraw from the contract within 30 days from receipt of the goods. The period starts from the date the customer or an authorized third party physically receives the goods.

Withdrawal must be communicated through a clear statement (e.g., email or letter). The deadline is considered met if the communication is sent before expiration.

Return of goods must occur within 30 days from the withdrawal notification. Return shipping costs are borne by the customer. Refund is made only after receiving and verifying the products.

The item can be tested as in-store, but prolonged use excludes full refund.

ARTICLE 7 – EFFECTS OF WITHDRAWAL In case of valid withdrawal, casaditempo.it refunds all payments received, including standard shipping costs (excluding additional costs for requested alternative methods).

Refund is made within 14 days from the withdrawal notification, using the same payment method, unless otherwise agreed. No fees are applied.

Refund may be suspended until receipt of the goods or proof of shipment.

ARTICLE 8 – EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply to:

  • customized products or made to the customer's specific request (e.g., engravings or tailored modifications);

  • items that, after delivery, are damaged or show signs of use beyond what is necessary to establish their nature, characteristics, and functioning.

ARTICLE 9 – PRICES AND PAYMENTS All prices include VAT. Any shipping costs are shown during checkout.

Prices may vary in case of error. There is no right to the incorrect price if the customer could have recognized it.

Accepted payment methods include credit cards, PayPal, and other digital systems. Payment must be made within 7 working days.

In case of delay, interest and reminder costs may be applied.

ARTICLE 10 – SHIPPING AND RETENTION OF TITLE Shipping takes place to the address indicated after payment is received. Times are indicated on the product page.

Partial deliveries are possible if reasonable. No additional cost is expected.

The goods remain the property of casaditempo.it until full payment. In case of default, return may be requested.

ARTICLE 11 – DURATION AND TERMINATION OF CONTRACTS

  • Open-ended contracts: terminable with 30 days' notice.

  • Fixed-term contracts: terminate automatically upon expiration, unless renewal is agreed.

  • Automatic renewal: only if expressly accepted, with the right of withdrawal at any time.

  • Promotional offers expire automatically unless otherwise specified.

ARTICLE 12 – COMPLAINTS AND DISPUTE RESOLUTION Any complaints must be sent to our customer service, including order number and detailed description.

We will respond within 14 days. In case of delays, the customer will be updated.

ARTICLE 13 – APPLICABLE LAW AND JURISDICTION

These General Conditions are exclusively governed by Italian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers who have their habitual residence in another member state of the European Union, the mandatory legal provisions of that state remain unaffected.

Any disputes arising from or related to these General Conditions shall be subject to the exclusive jurisdiction of the courts of Italy, without prejudice to the consumer's right to bring proceedings before the courts of their habitual residence member state.

ARTICLE 14 – DISPUTE RESOLUTION

All contracts concluded with consumers are governed by Italian law.
The consumer retains the right to resort to out-of-court dispute resolution tools and the European online dispute resolution platform ODR: https://ec.europa.eu/consumers/odr

ARTICLE 15 – MARKETING VIA SMS If you agree to receive SMS from casaditempo.it, you may receive messages related to orders, abandoned carts, promotions, or surveys. Consent is not mandatory to make purchases.

To unsubscribe, reply with "STOP" or use the included link. Other replies will not be recognized.

The service is free, but charges may apply from your operator.

casaditempo.it reserves the right to change the SMS sending number or code. We do not respond to messages sent to obsolete numbers.
